Is it essential to have the following statement on your invoice for it to be considered a legally binding Payment Claim under the Building & Construction Industry Security of Payments Act NSW?

“This is a Payment Claim made under the Building & Construction Industry Security of Payments Act 1999″

Answer: YES it is.

The NSW Act states in Section 13, Sub-section 2, Paragraph (a) that a Payment Claim “must state that the Payment Claim is made under this Act.”
